Authorisation for same products AN / AC
Biocidal products that are identical to an already authorised product (AN) or to a product family or to a single member of a product family (in connection with an authorisation AN) can be authorised as a same biocidal product AN/AC (Art. 15 para. 1 OBP)
The approval type is used, for example, in the following cases:
- Private label products (The reference approval holder produces the identical product for another person);
- The identical product is to be marketed in a different price segment.
The following two premises are distinguished:
- a) the applicant is identical with the holder of the authorisation for the reference product
- b) the applicant is not identical with the holder of the authorisation for the reference product
The associated reference product must either already be approved in Switzerland or be in the approval process (i.e. in parallel). This process is also described by the industry as «back-to-back» approval. These are identical products that are to be marketed under a different trade name or by a different approval holder.
Identical means that the biocide product is largely similar to the reference product, except for administrative changes (Art. 4 of the Biocide Products Enforcement Ordinance FDHA). An identical biocide product thus differs from the reference product only in administrative aspects (e.g. different trade names, other approval holder) or by restricted conditions of use compared to the reference product.
